Although humans go to zoos to look at animals, they do not generally see far beyond outward appearance and behavior. When a look is exchanged between human and animal that reveals too much, boundaries can melt away. When moats began to replace bars in zoos across Europe, and then around the world, a compromise was born that humans could handle. Hagenbeck’s ideas offered zoo-goers reprieve from unwittingly doubting their own self-identity while gazing into expressive eyes with emotions resembling their own. Making Sense of the Current Status of the Tony the Tiger Cases

We at the Animal Legal Defense Fund are committed to doing everything within our power to make sure that Tony finds his way to a reputable, accredited sanctuary where he can live out the rest of his life in an environment that caters to his needs rather than one that exploits him as a profitable spectacle.

To that end, our litigation team has been busy making sure that Louisiana’s big cat ban is defended and enforced. We are currently involved in three separate lawsuits concerning Tony, and with all the various developments, we thought it was time for a big picture overview on where things stand.

The first lawsuit is the one ALDF filed last April to have Michael Sandlin’s tiger permit revoked. In November, Judge Michael Caldwell ruled in our favor, holding that Mr. Sandlin was ineligible for a permit under the state regulations. Judge Caldwell ordered the Louisiana Department of Wildlife and Fisheries to revoke Sandlin’s permit and not issue any new permits. Mr. Sandlin and the Tiger Truck Stop have appealed that decision to the Louisiana Court of Appeal. We are currently waiting for the court to set a briefing schedule, which we expect in the coming months. It’s worth noting that the Department has complied with the court’s order and not issued a new permit to Mr. Sandlin, meaning that Mr. Sandlin and the Tiger Truck Stop continue to possess and exhibit Tony without the required permit.

In an attempt to remedy the Tiger Truck Stop’s open violation of the law, ALDF filed a second lawsuit to force the Department to enforce the state’s wildlife laws and turn Mr. Sandlin and the Tiger Truck Stop over to the District Attorney for prosecution.  Unfortunately, earlier this month, Judge Caldwell held that enforcement decisions by an agency are discretionary duties that cannot be compelled by the judiciary, and that our plaintiffs lacked legal standing to bring the case. (Standing is a constant hurdle in animal law cases that limits who can bring a lawsuit. More information on standing is available here and here.) We are still considering our options on whether to appeal the decision. Supporters should understand that the decision in this second case does not undermine our victory in the first case. Judge Caldwell’s original ruling that Mr. Sandlin cannot have a tiger permit still stands, and it is still illegal for Mr. Sandlin to possess and exhibit Tony. This loss means only that we cannot force the Department to enforce the law. The Department has said publicly that it intends to enforce Louisiana law once litigation has concluded. Although that is not the timeline we hoped for (after all, Mr. Sandlin and the Tiger Truck Stop are violating the law at this very moment and the Department could seize Tony at any time), we expect the Department will eventually do the job entrusted to it by Louisiana’s citizens: enforce the law and protect wildlife.

The third lawsuit is one filed by Mr. Sandlin and the Tiger Truck Stop against the State of Louisiana, the Department, and Iberville Parish, seeking to invalidate the state ban on private possession of big cats. If successful, the case would not only allow Mr. Sandlin to keep Tony, it could also open the floodgates to captivity for countless other captive wild animals. Mr. Sandlin and the Tiger Truck Stop did not name ALDF as a party to the suit, but given the high stakes, we insisted on being part of the case. We filed what is called a petition to intervene, which asks the court to allow the intervener into the case with the same rights and opportunity to be heard as the named parties. Although Mr. Sandlin and the truck stop objected to our intervention, Judge Janice Clark held that ALDF had a right to intervene in the case and granted our petition. Interestingly, we are now on the same side as the Department, our adversary in the other two lawsuits. Although we wish they were more proactive in enforcing the ban, both ALDF and the Department want the Louisiana big cat ban upheld. The next step is for our litigation team to file exceptions to Mr. Sandlin’s case and an opposition to his request for an injunction against the big cat ban.

We are optimistic that we will prevail and the court will uphold Louisiana’s right to protect public safety and animal welfare by prohibiting private possession of majestic animals like Tony. Our hope is that once Mr. Sandlin’s case is over, the Department will act quickly to ensure Tony’s removal to a humane sanctuary.

If this sounds complicated and frustratingly slow, that’s because it is. In order to manage large case loads and protect the due process rights of litigants, the legal system may take a while to resolve contentious issues. We too are growing impatient with every extra day Tony spends in captivity at the truck stop, and we are doing everything we can to accelerate his release to a proper sanctuary.

Animal rights group can help defend Louisiana law barring private ownership of big cats


NEW ORLEANS — An animal rights group can join a lawsuit and fight a challenge to a Louisiana law that bars private ownership of big cats, a state district judge ruled Monday.
Judge Janice Clark said the Animal Legal Defense Fund and two Louisiana residents can be parties to a challenge brought by Michael Sandlin, who has kept a tiger for decades at his Tiger Truck Stop in Grosse Tete.
Sandlin contends the law is unconstitutional. He opposed allowing the ALDF and two others to become parties to the suit.
"Upholding Louisiana's big cat ban will prevent untold harm in the future to other big cats like Tony, who deserve better than a sad life at a roadside truck stop," said Stephen Wells, executive director of ALDF.
Sandlin's attorney, Jennifer Treadway Morris, says she probably won't appeal this ruling because it can be part of her appeal if Clark upholds the law as constitutional.

Tony, a Bengal-Siberian mix, is the eighth tiger in 22 years at the truck stop. Sandlin and the truck stop company — Tony's legal owner — argue that moving the tiger now would be cruel.
In November, state District Judge Mike Caldwell ordered the Louisiana Department of Wildlife and Fisheries to revoke the permit that let Tiger Truck Stop Inc. keep the tiger at the business.
He also prohibited a new permit, saying the agency had broken its own rule allowing only individuals to own tigers.
The department has appealed the November ruling.

Good news! Iberville Parish  and Parish President J. Mitchell Ourso Jr. have been summoned to court Monday (May 7) of next week as part of a lawsuit involving the Grosse Tete truck stop tiger. Attorney Barry Marionneaux will represent Iberville Parish in the courtroom next week.
Michael Sandlin, owner of the truck stop and the tiger known as Tony, is suing the State of Louisiana through the Dept. of Wildlife and Fisheries, the Attorney General of the state, and Iberville Parish over the Petition in Intervention by the Animal Legal Defense Fund.
The present action is taking place due to the adverse ruling against Sandlin and his truck stop in the case of Animal Legal Defense Fund et al v. State of Louisiana Department of Wildlife and Fisheries et all that is pending in the 19th Judicial District Court.
The suit is in retaliation to a judgment made in a trial in November of 2011 that revoked Sandlin’s permit to keep the tiger and a final and permanent injunction was ordered against the Wildlife and Fisheries and granted the Animal Legal Defense Fund’s request for an injunctive relief. However, the court denied that Wildlife and Fisheries had to seize the tiger and released to the Animal Legal Defense Fund group. The state of Louisiana through the Wildlife and Fisheries was assessed costs of the 2011 proceedings.�

In today’s hearing in Baton Rouge, the judge ruled ALDF’s plaintiffs lacked standing in our lawsuit to force the Louisiana Department of Wildlife and Fisheries to do its job of enforcing Louisiana’s big cat ban now that the Tiger Truck Stop and Michael Sandlin are keeping Tony the tiger without a permit, in open violation of state law. The judge also ruled that department has discretion whether or not to enforce Louisiana’s law banning private ownership of big cats at this time.

Over 50,000 of Tony's supporter have signed an ALDF petition to the Louisiana Department of Wildlife and Fisheries over the past year, urging them to do their job—we're all getting tired of waiting for the department to do the job it's supposed to do and protect the best interests of both Tony and the public.

Today’s decision in no way affects the judge’s ruling that Michael Sandlin and the Tiger Truck Stop cannot be granted a permit to keep Tony. We fully expect that once all the legal proceedings relating to this case have wrapped up, the Department will do the job it is supposed to do and make sure Tony is no longer displayed without a permit. We are considering our options for appeal in today’s decision, and we are continuing to fight Michael Sandlin’s attempts to delay the inevitable day when Tony will finally go to a suitable forever home at a sanctuary where he can live out his days as a tiger should.

Group files another truck stop tiger lawsuit

NEW ORLEANS - An animal rights group has filed another lawsuit against Louisiana's Department of Wildlife and Fisheries seeking to have a tiger displayed at a Grosse Tete truck stop sent to a sanctuary.

The Animal Legal Defense Fund accuses the department of breaking the law by letting truck stop owner Michael Sandlin keep the animal, named Tony.

In November, a state judge ordered the department to revoke the permit given to Tiger Truck Stop Inc.

Sandlin's attorney, Stephen LeBlanc, says the department agreed not to enforce the order while the case is being appealed.

The new lawsuit, filed Thursday, seeks to have the department ordered to report Sandlin to local law enforcement.

Sandlin's website says big cat sanctuaries cannot give Tony the quality of care he gets at the truck stop.

Every human being has an internal moral sense in the treatment of animals, says Wayne Pacelle, president and chief executive officer of the Humane Society of the United States.
That moral sense is not taught, he says, and because of that, a child’s first impulse is to defend and care for animals.
As humans grow older and discover the power they have over animals, Pacelle says, that moral sense sometimes can get tangled, leading to animal cruelty.
Pacelle, the author of “The Bond: Our Kinship With Animals, Our Call to Defend Them,” is on a book tour promoting the paperback version of the book.
The first stop on the tour is Wednesday in Baton Rouge.
Pacelle chimed in on some animal-rights issues facing residents and government officials in the Baton Rouge area.
He is familiar with the Tony the Tiger controversy in Iberville Parish, Pacelle said.
The owner of the Grosse Tete truck stop, Tiger Truck Stop, has filed a lawsuit against the state and Iberville Parish in an effort to keep the 550-pound Siberian-Bengal mix tiger, Tony, on display.
The truck stop owner, Michael Sandlin, argues in the lawsuit he has a federal permit that has allowed him to keep Tony at the truck stop for 10 years and state and parish officials don’t have the right to override that permit and have Tony removed.
Pacelle said he strongly agrees with the animal welfare advocates who have fought to have Tony removed from the business.
“Keeping a tiger at a truck stop is archaic and needs to stop,” Pacelle said. “Wild animals belong in the wild.”
Moving the tiger to a zoo would be acceptable as well, Pacelle said.
Both Livingston and East Baton Rouge parishes face different issues as those areas cope with animal-control challenges.
In Livingston Parish, officials are discussing the creation of an animal-control program.
Officials have said the parish has not had the money to create and operate an animal-control program, even though the parish built a shelter on donated land years back.
Pacelle said well-run animal shelters are fundamental in the welfare of animals.
East Baton Rouge Parish has an animal-control facility, but following a split in powers last year, the city-parish now runs animal-control enforcement while a nonprofit organization, the Companion Animal Alliance, has been put in charge of shelter operations, including adoptions.
One of the goals of the Companion Animal Alliance is to transform the shelter into a no-kill facility, where only those animals that cannot be adopted or treated are euthanized.
“There are very few no-kill programs,” Pacelle said. “You can’t flip a switch and create one overnight.”
In his book, Pacelle writes that as harsh as nature can be for animals, cruelty comes only from human hands.
“In the end, whenever we humans find it in our ourselves to help powerless and vulnerable creatures, we are both affirming their goodness and showing our own.”

NEXT MONTH WILL BE A YEAR THAT THE ANIMAL LEGAL DEFENSE FUND FILED A LAW SUIT FOR TONYS ANIMAL RIGHTS...SADLY ENOUGH, THE LAW MOVES TOO SLOW AND WE STILL WAIT WHILE TONY IS AN ATTRACTION. On April 11, 2011, ALDF filed a lawsuit against the Louisiana Department of Wildlife and Fisheries (LDWF) and its secretary Robert Barham, arguing that he violated state law in granting a permit allowing Sandlin to exhibit Tony at the Tiger Truck Stop. UPDATE VIA ANIMAL LEGAL DEFENSE FUND

Update via Animal Legal Defense Fund
January 30, 2012: Last Monday, Judge Caldwell denied a motion brought by Michael Sandlin and the Tiger Truck Stop (TTS) that sought to suspend Judge Caldwell’s order while Sandlin and TTS appealed. In other words, Tony would have stayed put at the truck stop until after the appeal ran its course, which could take months. Instead, Judge Caldwell’s order instructing the Department to revoke the permit will go into effect right away. Sadly, this does not necessarily mean Tony is leaving the truck stop soon. Sandlin has filed his own lawsuit against the Department, which has been temporarily restrained from taking any action to remove Tony. Our attorneys are doing everything they can to resolve these conflicting orders to make sure Tony makes his way to a humane, accredited sanctuary as soon as possible.

....AND SO TONY SITS AND WAITS.....



Today we Received a Reply from the LDWF's Press Secretary Mr. Bo Boehringer. We all of course, are Wondering what is going on with Tony~ and why he still Remains at Tiger Truck Stop, when there is no Longer any Permit Keeping him there. Hopefully this will Answer your questions as to "Why"............ for now.

The District Court decision prohibiting the Department from issuing any further permits allowing the possession of the tiger is presently on appeal.



Additionally, the attorney representing the tiger’s owner has filed another law suit against the Department to have the regulations now in place declared unconstitutional. If that legal action is successful, the Department would no longer have jurisdiction over exotic big cats.



As part of the lawsuit, a temporary restraining order was signed by the judge prohibiting the Department from taking any action relative to removing the tiger from the Gross Tete, La. location.



The Department is prepared to take whatever action is dictated by the court system’s final ruling. Because of the two pending legal actions, however, the Department cannot take any action at the present time.

There have been so many back-and-forth motions in the battle over the fate of the Siberian/Bengal tiger, Tony (pictured), at the Tiger Truck Stop in Gross Tete, La., it would be next to impossible for me to summarize them. At once, it’s been quite a while since I posted an update, so here goes:
The most current action, as far as I can tell, has been that Tiger Truck Stop owner Michael Sandlin has sued the state of Louisiana and Iberville Parish over the constitutionality of their ban prohibiting “anyone from owning wild, exotic or vicious animals for display or exhibition.” It’s something of a countersuit, as a court in November ordered the tiger to be removed from the premises, revoking a state-issued permit on a technicality and prompting animal rights activists with the Animal Legal Defense Fund and other groups to claim victory in setting Tony free.
But the battle goes on.
One of the last couple times I wrote about the tiger, it was on the occasion of a group of drivers getting involved to call for the animal’s removal from the truck stop location. What do you think today?

Legal battle continues for Tony the Tiger


Tony the tiger is a Siberian-Bengal mix that is at the center of an animal advocacy battle between the owner, who wants to continue using the animal as a tourist attraction at a Louisiana truck stop, and advocates, who are fighting to have Tony relocated to an appropriate sanctuary.  Last year Louisiana’s Department of Wildlife and Fisheries and a federal judge ruled in favor of Tony by revoking the owner’s permit to keep the animal and making Tony’s relocation to a more suitable home a reality beginning the first of the New Year.
Unfortunately, a lawsuit was filed last week on behalf of the owner where this battle will now look at the constitutionality of the earlier decision.  So instead of focusing on the well-being of Tony, this matter is going to be tied up with legal jargon and red tape.  If the owner wins, he will not be allowed to own any other exotic animals but Tony will be stuck at the truck stop for the rest of his life.
This is such a tragic story.  If Tony was a human child there would be no controversy.  The well-being of the child would be the only focus.  Sadly, animals are still considered property and the decision to file this lawsuit is nothing less than a blood-sucking egotistical lawyer looking for a win.  The well-being of Tony is being completely ignored!
That is why we must not stop providing a voice for Tony.  Please take a moment to email or write the Louisiana Department of Wildlife and Fisheries (click here for contact information) and ask that they fight for Tony’s rights and well-being.  Animal lovers and advocates brought this matter to light and we must not allow Tony’s hope for sanctuary to fade away.

Grosse Tete’s tiger-jail turnkey claims in a new lawsuit against the state of Louisiana that the 700-square-foot enclosure at his shabby truck stop is actually a “safe haven” for the Bengal-Siberian tiger that lolls away its days getting ogled by travelers amid the din of interstate traffic and a bouquet of diesel fumes.
The Advocate is reporting Michael Sandlin is claiming in the suit that he has a federal permit to keep “Tony” and that the state Department of Wildlife and Fisheries doesn’t have the authority to prohibit his ownership of the animal. Sandlin has been repeatedly rebuffed in state court since a judge ruled last spring that his permit to own the tiger is invalid.
In his recent lawsuit Sandlin makes the dubious claim that his ownership of the tiger represents a sanctuary for such big cats, ignoring the fact that there are large, state-accredited sanctuaries for exotic animals that allow them some freedom to roam: “The fact is that the exotic animals in the wild are disappearing at alarming rates because of the illegal activity of criminal poachers,” Sandlin’s suit asserts. “Thus, private ownership and exhibits like Sandlin’s and Tiger Truck Stop’s has become the safe haven for these most precious of our endangered commodities.”

    The animal activist group who brought the initial suit (ALDF,discussed supra) against LDWF purport to be interested in the welfare of the exotic animals. In their zealous advocacy to end private ownership of same, they have lost sight of the well being of the very animals they claim concern and the ever dwindling population of these majestic endangered cats, and the important role private ownership and the exhibits play in assisting with the prevention of the complete extinction of several endangered species. Not to mention the substantial impact these LDWF regulations will have on interstatecommerce and the television and film industry.

    The animals in the care and control of responsible federally licensed individuals
    such as Tony and Petitioners herein, are well treated, fed, maintained and free from disease, as free from predators including illegal poachers, and secured from the public's harm or farmers and ranchers livestock all while being made available for public enjoyment and educational purposes in keeping with the clear intent of the federal law. There has not been any showing that Petitioners have abused Tony. However, the activist group at the heart of this regulation and current goal to steal Tony from Petitioners, have claimed such is occurring. The activist group is using sensational rhetoric and lies for their own economic benefit all in the name of preventing animal cruelty. However there has not ever been any cruelty found. Petitioners are in compliance with all federal laws and regulations and their USDA permit. These extremists claim Tony is exploited as a “cheap gimmick” because he is in an enclosure on business property. LSU.s Mike the Tiger is on LSU.s campus, under these extremists same argument, would also be a cheap gimmick subject to their attack. All animals in captivity and available for public viewing,according to these extremists are “exploited”. These extremist position is not consistent with the national interest of education of the public about these animals. These
    extremists likewise find use of animals in film and television offensive and under LDWF regulations, possession of animals and transport by these animal wranglers is also a crime.Further, the activist group wants Petitioners. particular animal removed from the
    only home he has known for ten years. The stress to an animal removed from its habitat is well known and documented. Removal of Tony would be cruel and inhumane treatment. Forcing him to an unfamiliar place away from his loving caretakers would be cruel and inhumane. Yet the animal activist don.t discuss what will happen to Tony should they succeed in their goal to have Tony removed from Petitioners.There are far too many interests at stake for this Court to allow one local state
    agency.s inconsistent rules with a chilling effect to private individuals cooperation with the Endangered Species Act and the significant impact this particular case will have on interstate commerce to stand especially in light of the overreaching effect and irrational ban on importation, breeding and requirement for sterilization without exception for all federally permitted exhibitors, breeders and zoos. When the federal government clearly articulates animals are integral part of interstate commerce and has taken hundreds of hours of testimony and crafted numerous versions of regulations over several decades, crafted a set of federal laws and regulations that properly balance all of the competing interests at stake and has allowed certain persons permits, for a state and political subdivision to ignore some but not all federal permits without any clearly articulated rational basis that furthers some actual local problem is repugnant to the Constitution and
    must be held unconstitutional.This interest group has been successful in getting this statute passed and this
    regulation adopted without accountability. They have been responsible for the coerced transfer of two privately kept cats, both of whom died within months of transport. Tony the Tiger at Michael Sandlin.s Tiger Truck Stop, is the current focus and potential next victim. If this statute and regulations are not declared unconstitutional now, then the nexttarget could be LSU.s Mike the Tiger. Additionally, these regulations and Parish Ordinance will unreasonably interfere with Louisiana.s developing television and film industry as the animal wranglers, who handle that industries performing animals are similarly situated USDA exhibitors as Petitioners and they will no longer be allowed to bring animals into the state for television and film purposes. These regulations and Iberville Parish Ordinance substantially interfere with interstate commerce by not yielding to all USDA Class C license holders.The fact is that the exotic animals in the wild are disappearing at alarming rates
    because of the illegal activity of criminal poachers. To think we can regulate and enact laws to stop illegal activity is naive. This activity can.t be regulated precisely because criminals do not follow laws. Thus, private ownership and exhibits like Sandlin.s and Tiger Truck Stops has become the safe haven for these most precious of our endangered commodities. Making it more difficult and expensive to assist with preserving these precious species is only furthering the likelihood that private citizens will stop assisting with the fight to prevent the complete extinction of these animals.

***Facts on the history of Tiger Truck Stop

Facts on the history of Tiger Truck Stop that seem to have been overlooked. The buying, breeding, selling and exploiting of tigers for what they call “conservation” has been going on for 30 plus years with Mr. Sandlin and his father before him.

A 1993 Iberville Parish County Ordinance prohibited the display of wild exotic animals as pets but was never enforced. The ordinance was amended on March 17, 2009 to allow Tony’s owner Michael Sandlin to keep Tony.

Mr. Sandlin then had to secure a license from the Louisiana Department of Wildlife and Fisheries. LDWF’s On December 14, 2009 the LDW&F granted a permit to allow Tony’s owner to keep him at the truck stop.

On November 6, 1989 Tiger Truck Stop raffled off an 11-month-old 350-pound Bengal tiger named Gloria who was living in a 16”x7”x7” cage attached to a flatbed trailer. The entry forms informed potential winners that they could “donate [her] to a zoo, sell [her], or give [her] to a friend” in the event that the winner did not want to keep the cub.

On December 14, 1993 according to The New Orleans Times- Picayune, Tiger Truck Stop was evacuated for five hours after a tanker truck ruptured, spilling 400 gallons of highly flammable aviation fuel at the truck stop.

On September 12, 1997 Tiger Truck Stop sold two tiger cubs for $2,500 to a couple passing through on a camping trip. One of the cubs suffered from fluid collection around the joints in her front legs, a condition linked to living on concrete.

November 5, 1997 The USDA cited Tiger Truck Stop for failure to provide shelter from inclement weather.

August 23, 1999 The USDA cited Tiger Truck Stop for unsanitary feeding practices, algae growth in the water receptacles, and poor housekeeping.

November 28, 2000 Tiger Truck Stop was cited again by the USDA for failure to correct previously identified violations of not providing veterinary care and mishandling tigers.

Baby tigers were being housed in a cage behind the counter in the store and used for pictures. Two 60lb white tigers were being housed in a 5”x 5” chain-link dog run, and Tony was tied up behind the counter in the store by a dog collar and leash.

In October 2001 two tiger cubs were taken in for declawing. The first evening at the veterinarian’s office, the male cub died.

Another tiger named Selena died mysteriously at the age of four and is now stuffed and mounted over the restaurant salad bar.

In April of 2003 after repeated violations of the Animal Welfare Act three of the four remaining tigers were removed from the facility, but Tony was left behind.

These are ONLY a handful of the many violations and citations over the years, yet Tony still remains at the truck stop.

THIS PICTURE OF TONY WHICH WAS TAKEN BY THE HUMANE SOCIETY OF LOUISIANA IS WHAT MADE "THE WORLD" PAY CLOSER ATTENTION TO WHAT WAS GOING ON WITH TONY.....
THIS IN TURN MADE "YOU" PAY CLOSER ATTENTION TO TONY. 

SOME MAY SAY "THE PAST IS THE PAST" , " A PERSON LEARNS FROM THEIR MISTAKES".......
WHICH IS FINE .
...........BUT WHEN A LIFE IS CONCERNED, AN ENDANGERED TIGER(S) LIFE IS CONCERNED, THEN "NO IT IS NOT FINE".  SO PLEASE LET US NOT FORGET THE VICTIM HERE IS "TONY THE TRUCK STOP TIGER"
